Estes termos estão disponíveis em inglês e dinamarquês. Esta é a versão inglesa.

Terms of use and sale

These terms cover the overachiever.eu website, the purchases you can make on it, and Overachiever Coach (the Coach web app and the iPhone app), including Coach subscriptions.

1. Who we are

The seller is Overachiever, a sole proprietorship (enkeltmandsvirksomhed) owned by Giovanni Degani, CVR 46141717, Lyngbyvej 83A, 2100 Copenhagen Ø, Denmark (“Overachiever”, “we”). Contact: [email protected].

2. Who can use Overachiever

You must be at least 16 years old to create an account, make a purchase or use Overachiever Coach. The Coach asks you to confirm your age when you sign up. The free plan generator on the website needs no account.

3. Your account

Give a working email address and keep access to it secure: anyone who can open your sign-in emails can sign in as you. An account is for one person. Tell us if you think someone else has used your account.

4. One-time purchases on the website

  • Overachiever Premium: €29 (in kroner on the Danish pages, 219 kr), a one-time payment for lifetime access to Premium on the website.
  • Training program converter: included in Premium and in Coach subscriptions, and no longer sold on its own. If you bought the converter separately before, you keep it.

Premium is a one-time payment, not a subscription. Prices include VAT. Payment is handled by Stripe; we never see your card details. The purchase is added to your account as soon as the payment succeeds, and what it unlocks is described on the pricing page. Premium doesn't include the Coach. An active paid Coach subscription includes Premium on the website (see section 5).

5. Overachiever Coach subscriptions and auto-renewal

  • Coach: €12 a month or €79 a year. Coach Voice: €19 a month or €139 a year. Prices include VAT. On the Danish pages: Coach 89 kr a month or 589 kr a year, Coach Voice 149 kr a month or 1.049 kr a year.
  • On the web you pay with Stripe. The subscription renews every month or every year, matching the plan you chose, until you cancel it. You can switch between Coach and Coach Voice, and between monthly and yearly, in the Coach web app (Settings › Subscription › Manage billing).
  • Premium included: while a paid Coach or Coach Voice subscription is active, Premium on the website is included for the account with the same email address, including the converter. It ends when the subscription ends. The free trial doesn't include Premium. The Diet Planner's meal plans stay 18+ however you get Premium.
  • On iPhone you pay through Apple's In-App Purchase. Billing, renewal, cancellation and refunds are handled by Apple under Apple's terms, and Apple's standard licensed application end user licence agreement applies to the iPhone app in addition to these terms.
  • One account has one plan, wherever it was paid.
  • Fair use is part of each plan. Coach Voice includes voice coaching under a monthly fair-use allowance, counted in whole minutes; when it's used up, voice stops until the next month. Photo or label analyses are limited to 30 a day on Coach and 60 a day on Coach Voice, and there is a daily limit on coach messages.
  • Coaching (a person, the trainer, coaching another person, the athlete, in the app) is included in Coach and Coach Voice. The athlete needs their own active plan or trial, and AI and voice use while coaching counts against the trainer's plan.
  • If we change a subscription price, we tell you in advance, and the new price applies from your next billing period after the notice. You can cancel before it takes effect. On iPhone, Apple's price-change process applies.

6. Free trial

  • Web: new accounts can start a 14-day free trial of Coach (text, not voice) with the “Start 14-day trial” button in the Coach web app. When the trial ends, the coach features stop unless you choose a plan.
  • iPhone: Apple's 14-day introductory free trial is offered for Coach or Coach Voice when your Apple ID is eligible. Unless you cancel at least 24 hours before it ends, it turns into a paid subscription, as Apple shows you before you confirm.
  • Trials don't stack. An account that has already had a trial or a subscription, on the web or through Apple, doesn't get another trial.

7. Cancelling

Web subscriptions: cancel at any time in the Coach web app (Settings › Subscription › Manage billing) or by emailing us. The plan stays active to the end of the period (month or year) you've paid for and isn't renewed. Deleting your account cancels a web subscription automatically. iPhone subscriptions: cancel in your Apple ID settings (Settings › your name › Subscriptions). Deleting your Overachiever account does not cancel an App Store subscription.

Apart from the right of withdrawal below and what the law otherwise requires, we don't refund part-used subscription periods.

8. Right of withdrawal (14 days, EU consumers)

If you're a consumer in the EU, you normally have 14 days to withdraw from a purchase. For our digital products the rules are:

  • Premium (one-time digital content, and the converter if you bought it separately before) is made available straight after payment, so you ask for that before you pay. Next to the buy button there is a box, unticked by default, that reads: “I want access right away and agree that I lose my 14-day right of withdrawal once access starts.” You can only continue to payment once you've ticked it. By ticking it you consent to immediate access and acknowledge that your 14-day right of withdrawal ends once access starts. We record that consent with your purchase and confirm it, with the purchase date, in the email we send after payment.
  • Coach subscriptions bought on the web (a digital service) start straight away at your request. You can still withdraw within 14 days of subscribing; you then pay only for the days you used, in proportion to the subscription period, and we refund the rest. The free trial covers most of that window, so in practice you can try the Coach before you pay.
  • Purchases on iPhone are made with Apple, so Apple's refund rules apply and refunds are requested from Apple (reportaproblem.apple.com).

To withdraw, send us a clear statement by email to [email protected], for example: “I withdraw from my contract for [product], bought on [date], with the account [email address].” We refund within 14 days of receiving it, to the payment method you used.

9. Acceptable use

Don't use Overachiever to break the law or to harm others. In particular, don't:

  • try to get around limits, payments or security, or access other people's accounts or data;
  • copy, scrape or resell the service or its content in bulk, or reverse engineer the apps except as the law allows;
  • use the coach to create unlawful, abusive or harmful content, or to attack, overload or probe our systems or our AI providers;
  • share your account, or upload another person's data without the right to do so;
  • invite someone as your athlete without their agreement, or use what an athlete shares with you for anything other than coaching them.

We may suspend or close an account that breaks these rules. Where we can, we tell you first and give you the chance to explain.

10. The Coach is training and nutrition coaching, not medical advice

Overachiever Coach is an AI coach for training, food and supplements. Its replies are AI-generated, general training and nutrition information, not medical advice: it doesn't diagnose, treat or prevent any condition, and it isn't a substitute for a doctor, physiotherapist, dietitian or pharmacist. AI answers can be wrong or incomplete, so check them against how you feel and your own judgement, and read the disclaimer. The coach only changes your plan or logs when you approve a proposal. If you have urgent symptoms, stop and call 112 or your local emergency number. Ask your doctor or pharmacist about medications and high doses of supplements.

A trainer you invite through Coaching is an independent person, not our employee or agent, and is responsible for their own advice.

11. Your data and content

What you log and write stays yours. You let us store and process it to provide the service to you, as described in the privacy policy (Overachiever Coach: Coach section). You can download your data and delete your account at any time.

12. Our content

The website, the apps, the generator and the Coach, and Overachiever's own illustrations and animations belong to us. The Exercise Knowledge Graph data is licensed under CC BY-SA 4.0 (see attribution). Other names and trademarks belong to their owners.

13. Availability and changes

We work to keep Overachiever available and accurate, but we can't promise that it's always available or free of errors. Features marked beta can change or end. We may improve or change features; if a change takes away something important you've paid for, we tell you and you can cancel.

14. Liability

To the extent the law allows, we are not liable for indirect or consequential loss (such as lost profits or lost data that could have been exported), and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by negligence, for gross negligence or intent, or your mandatory rights as a consumer (for example in case of defects).

15. Ending the agreement

You can stop using Overachiever and delete your account at any time (Coach: Settings › Data & devices › Delete account; website: Account). We may end the service for you with reasonable notice, or straight away for a serious breach of these terms.

16. Changes to these terms

If we change these terms in a way that matters, we tell you in advance by email or in the app. If you don't agree, you can cancel before the change takes effect.

17. Law and complaints

Danish law applies. If you're a consumer, you keep the protection of the mandatory rules of the country where you live. Contact us first with any complaint. You can also complain to the Danish Consumer Complaints Board (Forbrugerklagenævnet, through Nævnenes Hus, naevneneshus.dk), or take the matter to the courts of Denmark or of the country where you live.
